Complaint 2 - Manure Pile

 

Manure PileYou receive a complaint about a manure pile and consider your response.
What do you do?

You get the information then look at the LHO Complaint Flow Chart and the statutes.

In this complaint you log all the information for the record from the complainant.

  • You learn this is a new manure pile in a barnyard close to a property line.
  • The caller says the pile is near the property line and his well is 50 feet away.
  • The owner of the animal is unwilling to work with the neighbor to remedy the situation.

You look at the reference material available and determine the law addresses manure as well as general nuisances. (Title 17, §2701-B. Action against improper manure handling). This law provides relief through court action, and, with the assistance of the Department of Agriculture, Food and Rural Resources, a fine can be levied up to $1,000 and a $250/day assessment.

You decide to see if this can be worked out without court action. You schedule a visit with the owner, make a follow-up, and send a summary letter. You suggest simply moving the pile as there is room on the other side of the barn.
