As LHO, you will receive complaints from a variety of sources. Some will be legitimate, some will not. Take each one seriously, and consult the flowchart so you are consistent in your actions. As can be seen by these three differing situations, there will generally be a statute you can go to. Some statutes will help more than others, however.

As stated previously, the LHO has to present him/herself in a manner so as to not be heavy-handed. Most importantly, use due process and be polite.

These examples also show that no situation is the same – and that people often see the same situation differently. It is important to make sure you have someone visit the property with you. In the case of the OWB, you can see the importance of having the Fire Chief present. He or she has more experience in matters dealing with fires and is a natural for such discussions.

Although you cannot be all things to all people, you can be an important contributor to the overall health of your community.

If you can’t work things out your options range from putting a lien on the property if allowed, have the CEO go to court under the authority of Rule 80K, and lastly, hire an attorney and go to court.
