At this point, if it is clear the owner is unwilling to take corrective action, the municipality will have no alternative but to go to District Court.
- The law states that if there is an appeal to any order, or there are excessive delays to any orders given, you can go to District court and request the Judge to have the owner correct the situation.
- In all cases, the court will not simply agree with the municipality. The court, as the municipality does, will want to try to always work out some sort of agreement using due process.
- If the Local Health Officer or the Code Enforcement Officer has been trained to go to court under the provisions of Rule 80K (a rule of court) then the CEO or LHO can represent the municipality in court without an attorney.
You are at the end of the road after you have exhausted these steps.
